New Jersey Couldn’t Even Convince Sotomayor and Ketanji That What They Did to Pro-Life Groups was Ok, They Lose 9-0

The Supreme Court just delivered what might be the most satisfying ruling of the entire term — and given what else they dropped this week, that’s saying something. In a *unanimous* decision, all nine justices ruled that New Jersey violated established precedent by intimidating pro-life organizations. Not 6-3. Not 5-4 with a snarky dissent from Sotomayor. Nine. To. Zero. Every single justice on the bench looked at what New Jersey did and said, “Yeah, no, that’s not how America works.”

Let that marinate for a second. Sonia Sotomayor — the woman who writes dissents like she’s drafting fundraising emails for Planned Parenthood — sided against the blue state. Elena Kagan, who has never met a progressive cause she wouldn’t bend the Constitution to support, sided against the blue state. When you lose the liberal wing of the Supreme Court on a case involving pro-life groups, you didn’t just cross the line. You crossed the line, kept running, and fell off a cliff. New Jersey managed to be so aggressively, obnoxiously wrong that they united the most divided Court in modern history against them.

So what did the Garden State actually do? What it always does — tried to use the machinery of government to crush people who disagree with the ruling political class. Pro-life organizations operating legally in New Jersey found themselves on the receiving end of state intimidation campaigns. We’re talking about groups that counsel women, offer resources, and exercise their First Amendment rights to speak about the sanctity of life. New Jersey’s response to these constitutionally protected activities was essentially: nice little organization you’ve got there, shame if something happened to it.

The state used regulatory threats and legal pressure to try to silence groups whose message they didn’t like. Not because these organizations broke any laws. Not because they harmed anyone. But because their viewpoint — that unborn children have value — made the political establishment in Trenton uncomfortable. And when you’re a one-party state run by people who think “tolerance” means “agreeing with us,” discomfort is the same thing as a crime.

The Court didn’t just rule against New Jersey. They *rebuked* them. The decision reinforced that states cannot use intimidation tactics against organizations engaged in protected speech, regardless of whether the state finds that speech distasteful. This isn’t some novel legal theory the conservative justices invented. This is bedrock First Amendment law that New Jersey apparently forgot exists — or more likely, hoped nobody would enforce.

And that’s the real story here. New Jersey didn’t accidentally stumble into unconstitutional behavior. They *chose* it. They looked at pro-life groups exercising their God-given rights, decided those rights were inconvenient, and tried to bully them into shutting up. It’s the same playbook blue states have been running for years: if you can’t win the argument, weaponize the government against the people making it.

We’ve seen this movie before. New York tried to bankrupt the NRA through regulatory warfare. California tried to force pro-life pregnancy centers to advertise abortion services. Illinois tried to compel doctors to refer patients for abortions against their conscience. Every time, the left tests the boundaries of government power against people of faith and people of conscience. And every time they get caught, they act shocked — *shocked* — that the Constitution applies to everyone, not just people who vote Democrat.

What makes this ruling particularly devastating for the left is the unanimity. They can’t play their usual game. They can’t scream about “MAGA judges” or a “partisan Court” or “stolen seats.” Every justice they put on that bench looked at what New Jersey did and agreed it was wrong. There’s no dissent to cherry-pick quotes from. There’s no “well, actually” footnote they can cling to. It’s a clean, unambiguous, nine-justice beatdown.

Governor Murphy — or whoever is currently pretending to run New Jersey while the state crumbles under its own tax burden — hasn’t said much yet. Probably because there’s nothing to say. When the Court rules unanimously against you, your options are: accept it, or look even more ridiculous than you already do. Given New Jersey’s track record, I’d give it about 48 hours before some state legislator proposes a bill to do the exact same thing with slightly different wording.

But here’s what matters for the rest of us. This ruling sends a clear signal to every blue-state attorney general, every progressive governor, and every bureaucrat with a political ax to grind: you cannot use the power of the state to intimidate Americans out of exercising their constitutional rights. Not their gun rights. Not their speech rights. Not their religious rights. Not any of their rights. The First Amendment isn’t a suggestion, and it doesn’t come with a progressive exemption.

The pro-life movement has been taking body blows from hostile state governments for years. They’ve been investigated, harassed, fined, defunded, and dragged into court for the crime of offering women an alternative to abortion. And through all of it, they kept showing up. They kept counseling. They kept praying. They kept exercising their rights even when the government tried to make it as painful as possible.

Today, the highest court in the land — every single member of it — told them what they already knew: you have every right to be here, and nobody gets to bully you into leaving.

Nine to zero. Even the ones they thought were on their side. That’s not a ruling. That’s an embarrassment. And New Jersey earned every bit of it.
