Letitia James Built Her Career on Prosecuting Political Enemies — Now Her Own Bar Is Investigating Her

Three days before Governor Kathy Hochul appointed her office to oversee the case, New York Attorney General Letitia James posted on social media that the accuser in the Cornell University sexual assault case had been "forced to endure" something "horrific and unacceptable." She added: "To her, and to all survivors: you're not alone. We stand with you." The seven men she'd be tasked with impartially investigating hadn't been tried yet.

Now she's the one answering questions about ethics.

The National Legal and Policy Center, a Virginia-based watchdog group, has filed a nine-page complaint with New York's Attorney Grievance Committee alleging James violated professional conduct rules with her September 28 comments about the "Cornell 7" — seven former Chi Phi fraternity members accused of sexual assault in an incident dating to October 2024. The complaint argues that a prosecutor publicly declaring a complainant's account "horrific and unacceptable" before an investigation begins isn't empathy. It's prejudgment.

Defense attorneys for the accused aren't waiting for the bar to act. Andrew Miltenberg, representing one of the defendants, has filed a recusal motion arguing James cannot credibly lead the prosecution. "The public needs confidence that the person directing this investigation will evaluate the evidence with an open mind," Miltenberg said. Attorneys Teny Geragos, Marc Agnifilo, and Jacob Kaplan — representing defendants including Winston Lee and Gillio Lopes — have filed similar motions.

James's office responded that the investigation would be guided by "nothing but the facts, the evidence and the law." During a debate, James herself leaned into the moment, calling for "empathy" and insisting that "what we need now more than ever in our body politics is more empathy." She added: "Politics stops at the door in my office."

That's a fascinating standard from the attorney general who ran for office on an explicit promise to investigate Donald Trump. Politics didn't stop at her door — it was the campaign platform. She built a political career on the premise that the AG's office existed to pursue one man, then pivoted to claiming prosecutorial neutrality the moment her own conduct came under scrutiny.

The complaint raises legitimate questions about whether James's public statements created an appearance of bias that undermines the defendants' right to a fair process. Tompkins County District Attorney Matthew Van Houten originally handled the case before Hochul transferred it to James's office — a move that now looks less like an upgrade in resources and more like a handoff to someone who'd already picked a side.

Republican attorney general candidate Saritha Komatireddy has seized on the episode, arguing it illustrates a pattern of James using the office for political ends rather than impartial justice.

The bar complaint doesn't allege James broke the law. It alleges she broke the rules her own profession wrote for itself — the rules that exist specifically to prevent prosecutors from turning cases into performances. James spent years arguing that Trump's legal team couldn't be trusted to follow norms. The Attorney Grievance Committee is now asking whether she can.

Seven defendants, a nine-page ethics complaint, and a recusal motion. Politics stops at the door.
