California School Threw a Kid in a Psych Ward for a Pro-Trump Flyer — Now There's a Lawsuit

On February 6, a student at Torrey Pines High School in San Diego, California distributed a flyer on campus. It featured a play on "LGBT" — the Statue of Liberty for "L," a rifle for "G," a glass of beer for "B," and a photo of President Trump for "T." Within a week, the student — identified in court documents only as M.F. — had been interrogated by police, placed on a 5150 psychiatric hold, and locked overnight in a mental health facility.

For a flyer.

According to the lawsuit, assistant principal Angela Guerrero issued M.F. two days of detention three days after the flyer was distributed, claiming it had "frightened" other students. That was just the beginning. Teacher Theresa Barnes allegedly accused M.F. of conducting computer searches for "how to load a Glock," "how to load a magazine," and "how to dispose of a body."

The lawsuit flatly denies every one of those accusations. "M.F. did not research how to load a 'glock,' did not confess to murder, was not watching homicide videos, and did not target the LGBT community," the filing states. But by the time anyone checked whether those claims were true, M.F. had already been pulled from class and interrogated.

The next day, 5 to 6 police officers arrived at the school. M.F. was placed on a 5150 involuntary psychiatric hold — the California statute that allows someone to be confined against their will for up to 72 hours if deemed a danger to themselves or others. The student spent the night in a mental health facility. School officials refused to allow M.F.'s parents to see their child, instead requiring them to speak with a crisis social worker.

Law enforcement searched the family's home and M.F.'s bedroom.

When M.F. returned to school — cleared by actual mental health professionals, mind you — the punishment continued. The student was barred from playing varsity baseball. Forced into counseling sessions. Pushed toward Special Education testing. Classmates labeled M.F. an "LGBT bully."

So let's walk through the sequence. A student puts up a joke flyer — the kind of edgy humor you'd find on any college-aged kid's social media feed. The school decides the flyer is threatening. A teacher then accuses the student of researching how to load firearms and dispose of bodies — accusations the lawsuit says are fabricated. Police show up. The student is involuntarily committed to a psychiatric facility overnight. Parents are denied access. The home is searched. And when the student comes back, he's stripped of extracurriculars and funneled into a special education track.

There's a term for institutionalizing political dissidents in psychiatric facilities. We used to associate it with the Soviet Union. The practice was called "punitive psychiatry" — diagnosing inconvenient political opinions as mental illness so the state could lock people away without a criminal charge.

The lawsuit doesn't just allege that M.F.'s rights were violated. It alleges that school officials manufactured justifications to escalate a political disagreement into a mental health crisis. That the computer search accusations were invented. That a student who committed no crime and made no threat was treated like a school shooter because adults in positions of authority didn't like the politics on a piece of paper.

Detention for a flyer is overreach. A 5150 hold is something else entirely.
