The Trump Justice Department filed an amicus curiae brief with the Supreme Court on Friday urging the justices to strike down state and local bans on AR-15-style semiautomatic rifles. The filing targets two cases at once — Viramontes v. Cook County out of Illinois, and Grant v. Higgins out of Connecticut.
Republican administrations have been promising to defend the Second Amendment at the Supreme Court level for decades. This one actually did it.
Solicitor General D. John Sauer submitted the brief, arguing that AR-15-style rifles are constitutionally protected arms in common use by law-abiding Americans for lawful purposes. That's not an abstract legal theory. It's the standard the Supreme Court itself established — firearms "in common use" are protected, full stop. The AR-15 is the most popular rifle in America. Trying to argue it isn't "in common use" is like arguing pickup trucks aren't common on American roads.
The two cases represent the main fronts of the AR-15 ban fight. Cook County, Illinois enacted a local ban. Connecticut has a statewide prohibition. By filing in both cases simultaneously, the DOJ is signaling that it wants a ruling broad enough to wipe the board — not a narrow, jurisdiction-specific decision that leaves half the country's bans standing.
Multiple sheriffs have also filed briefs in support of striking down the bans, arguing that the prohibitions endanger law-abiding citizens. These aren't Washington lobbyists or think-tank lawyers. These are elected law enforcement officers telling the Supreme Court that disarming their own residents makes their communities less safe.
The gun control lobby will respond with the usual playbook — invoke mass shootings, call the AR-15 a "weapon of war," and argue that the Founders never imagined semiautomatic rifles. Which is an interesting constitutional theory, given that the Founders also never imagined the internet, and yet the First Amendment still applies to it. The Second Amendment doesn't contain an expiration date or a technology clause. It says "arms." The AR-15 is an arm. The analysis ends there.
What makes the DOJ's move significant isn't just the legal argument — it's the positioning. This brief lands as the Supreme Court prepares for its next term. The justices now have the executive branch of the federal government formally on record saying these bans are unconstitutional. That's a different weight than another amicus brief from the NRA or a gun rights foundation. This is the government of the United States telling the court that state and local governments have overstepped.
Connecticut and Cook County built their bans on the assumption that no federal administration would challenge them at the highest level. For years, that assumption held. Republican presidents talked about the Second Amendment on the campaign trail and went quiet once the lawyers got involved.
The brief is filed. The sheriffs are on record. The court has the case. The only question left is whether the justices will say what the Constitution already does.
