Trump Admin Cracks Down on H-1B Visa Abuse

The Trump administration is taking new steps to protect American workers by looking closely at how companies use a visa program called H-1B. This program allows companies in the United States to hire foreign workers for specialized jobs, especially in areas like computer science and engineering. These jobs usually require a college degree. But some say the program is being abused and is hurting American citizens who are looking for good jobs.

Harmeet Dhillon, who works for the Department of Justice as the head of the Civil Rights Division, explained that her team is focusing on cases where companies may be choosing foreign workers over Americans simply because they are cheaper to hire. She said this kind of discrimination is against federal law and that her team is ready to act.

Dhillon recently told a crowd at the National Conservatism Conference that her department received nearly 100 new complaints over Labor Day weekend. These complaints came after she reminded her colleagues that federal law protects American workers from being passed over unfairly. She also criticized previous administrations for not enforcing these rules.

One of the main concerns is that companies use the H-1B visa program to save money by hiring workers from overseas at lower wages than they would pay Americans. Simon Hankinson, a senior research fellow at The Heritage Foundation, said the program mostly benefits workers from India, and that many skilled American workers are being left out. In fact, more than 70 percent of H-1B visa holders are from India, and around 12 percent are from China.

Hankinson also pointed out that many young Americans were told to learn computer programming because it was a good career path. But now, even those who followed that advice are having trouble finding jobs because companies are hiring foreign workers instead.

To prevent abuse of the H-1B program, employers are required to try to hire American workers first. Labor Department rules say companies must post job openings in at least two large Sunday newspapers before applying for H-1B visas. But critics say this process is often treated as a formality, and companies still prefer foreign workers.

Still, not everyone agrees with the Trump administration’s tougher stance. In May, several House Democrats and one Republican wrote a letter to Secretary of State Marco Rubio asking for a pilot program to make it easier for H-1B holders to renew their visas. They said keeping skilled workers in the U.S. helps businesses stay competitive.

Elon Musk, the well-known entrepreneur behind companies like Tesla and SpaceX, has also spoken about the H-1B program. He said he might not have come to the U.S. without it. But even Musk agrees the program needs to be reformed to stop abuse.

The government has already found signs of fraud in the system. In 2024, U.S. Citizenship and Immigration Services found more than 400,000 duplicate entries in the H-1B visa lottery. Some companies reportedly tried to game the system by entering the same person multiple times to increase their chances of winning a visa. This led to criminal investigations, even before the Biden administration left office.

Now, under President Trump, the Department of Justice is sending a clear message: American workers come first. The administration is not trying to shut down all immigration or stop skilled workers from coming to the U.S. But it does want to make sure the laws are fair and that American citizens are not being left behind.

This effort also ties into a larger debate over how the U.S. handles immigration and jobs. Some states may begin to take their own steps to protect local workers, especially if they feel the federal system is not working. As the 2026 midterm elections approach, expect this issue to remain a key topic in national politics.
