After the U.S. Court of International Trade recently struck down Trump’s “Liberation Day” tariffs, Kennedy took to the airwaves, warning that the Supreme Court must step in swiftly to stop activist judges from undermining our nation’s executive authority.
Speaking on Fox News’ “The Ingraham Angle,” Senator Kennedy expressed frustration with the latest judicial overreach, sarcastically remarking he was “shocked” that federal judges had once again tried to hamstring President Trump and Congress’s lawful authority—a situation, he quipped, that hadn’t occurred “since yesterday.”
Kennedy’s frustration is understandable. The Constitution clearly entrusts tariff-setting powers to Congress, which in turn delegated a measure of that authority to the President. “Congress gave it to him,” Kennedy reminded viewers. Whether Congress was “prudent” in delegating this authority is open to debate, Kennedy acknowledged, but what’s not debatable is Trump’s legitimate right to exercise the powers entrusted to him.
“Well, sooner or later, the Supreme Court is going to have to address this,” Kennedy warned. “Those who oppose the executive branch and those who oppose the legislative branch and are seeking recourse in the courts are at some point going to dig up more snakes than they can kill.”
Kennedy’s warning is not hyperbole. Time after time, we’ve seen unelected judges—often appointed by leftist administrations—attempt to subvert the will of the American people by blocking Trump’s America First agenda. The Court of International Trade’s recent ruling is just the latest example. The three-judge panel—comprised of appointees from Presidents Reagan, Obama, and Trump—handed down a decision that threatens to undermine Trump’s strategic economic policies designed to rebuild American manufacturing and assert our economic sovereignty.
The Trump administration immediately appealed the decision, reinforcing their unwavering commitment to reviving domestic industry and protecting American workers. The White House rightly criticized these “unelected judges” for inserting themselves into matters of national economic security—decisions that should rest primarily with elected leaders, accountable directly to the American people.
This judicial activism isn’t merely a procedural annoyance—it’s a direct attack on the fundamental separation of powers. By repeatedly dragging the administration’s policies into courtrooms, left-wing activists and globalist interests aim to run out the clock on Trump’s presidency, hoping to prevent him from fully implementing the policies that voters overwhelmingly support.
The stakes could not be higher. As Trump continues to navigate complex international trade negotiations, judicial interference risks weakening his hand against foreign adversaries like China. Just recently, the administration asked American companies to halt sales of sensitive semiconductor-design software to China, a move that’s critical to protecting national security and maintaining American technological dominance. These bold steps, essential to safeguarding our industrial base, are precisely what activist judges threaten to derail.
Senator Kennedy understands what’s at stake. He’s right to demand swift Supreme Court action to rein in these rogue judges. The high court must step up and reaffirm the limits of judicial power, clearly stating that unelected judges have no business meddling in economic and national security policies set by the President and Congress.
The Trump administration’s America First agenda represents the will of the voters and the best interests of our nation.
