During an interview on FNC’s “Hannity” on Monday, Alan Dershowitz, emeritus Harvard law professor promised to challenge any gag order imposed on former President Trump regarding his sealed grand jury indictment.
If the lawsuit is heard in Manhattan, according to Dershowitz, things won’t go well for Trump.
“My question for you is: How is it possible — how is a judge able to revoke an American’s right to speak up for themselves in a — on a extremely public case such as this?” Hannity inquired.
“Judges have tragically done that, and they have done it recently. I was happy to see Joe being optimistic that the court will not do it in this particular case, but if they do, I will immediately bring together some of the best First Amendment attorneys in America as amicus considering we would end up being the victims,” Dershowitz responded. “The First Amendment guarantees two liberties. According to Justice Thurgood Marshall, the right of the speaker is essential, but so is the right of the audience. But I pray that doesn’t happen because it would be a death strike to the First Amendment. Today, you could not even rely on the American Union of Civil Liberties to protect the First Amendment on Donald Trump’s behalf due to the fact that they would be stripped of all of their financing.”
“You know, really the only thing I disagree with Joe on is that he’s a fantastic lawyer. I believe he is overly optimistic. I can’t picture an elected judge in Manhattan dismissing this case and then having to tell his family, friends, or business partners, I’m the attorney that freed Donald Trump. All he needs to do is recall what had happened to me when I supported — just stood by Donald Trump in the Senate, lost every one of my clients, friends, business partners, and no judge wants to be, quote, ‘Dershowitz-ed,’” he said. “As a result, you won’t be able to get a fair evaluation of the statute of limitations or change of venue. If it’s attempted in Manhattan, this is a fixed issue.”
