Bathroom Battle: Feds Rule Against Denver Schools!

The U.S. Department of Education recently ruled that Denver Public Schools broke federal law when it changed a girls’ bathroom into an all-gender restroom. This decision could have a big impact on how schools across the country handle bathroom policies, especially when it comes to students who identify as transgender.

At the center of the issue is East High School in Denver, Colorado. The school turned one of its girls’ bathrooms into an all-gender restroom. That means students of any gender could use it. The school district said students helped make this decision and tried to ensure privacy by installing tall partitions around each toilet. Later, the school added a second all-gender bathroom on the same floor. Throughout the process, the district said students still had access to regular boys’ and girls’ bathrooms, as well as single-stall, all-gender restrooms.

But the U.S. Department of Education, under the Trump administration, said this setup violated Title IX. Title IX is a federal law that bans sex-based discrimination in education. The Office for Civil Rights, which is part of the Education Department, opened an investigation into the school in January 2025. After reviewing the facts, the department said allowing students to use bathrooms based on gender identity, instead of biological sex, is not allowed under the law.

Craig Trainor, the acting assistant secretary for civil rights, explained the decision. He said the school violated Title IX by changing a sex-separated girls’ restroom into an all-gender facility. He also said the school broke the law by letting students use bathrooms based on gender identity rather than their biological sex.

To fix the issue, the federal government gave the school district a proposed resolution. The district has 10 days to agree to the changes or face enforcement action. The resolution includes four main points:

1. Turn the all-gender bathrooms back into separate boys’ and girls’ bathrooms.
2. Remove any school policies that allow students to use bathrooms based on gender identity.
3. Use biology-based definitions of “male” and “female” in all school policies that involve Title IX.
4. Send out a message to all schools in the district explaining that bathrooms must protect students’ privacy and safety and be equally accessible to both sexes.

The memo must also make it clear that girls cannot be treated unfairly in any school program or activity.

This decision is part of a broader push by the Trump administration to return to biology-based rules in schools. In February, President Trump signed an executive order to stop transgender girls from playing on girls’ sports teams. Earlier this week, Republican lawmakers in the House introduced a bill to prevent transgender students from using bathrooms or joining sports teams that match their gender identity instead of their biological sex.

This Title IX case highlights a growing debate across the country. Some people believe students should be able to use facilities that match their gender identity. Others argue that biological sex should be the deciding factor, especially when it comes to privacy and fairness.

Supporters of the federal decision say it protects girls’ rights and privacy. They argue that Title IX was created to ensure equal opportunities for girls and women in education. Letting biological males into girls’ bathrooms, they say, goes against that goal.

Critics, however, say the ruling could make transgender students feel less safe or accepted at school. They worry it could limit their ability to participate fully in school life.

The outcome of this case could affect school policies in other states. If the Denver school district does not comply, it could lose federal funding or face legal action. And if more districts come under investigation, the country could see a shift back toward stricter rules based on biological sex in public schools.

For now, the Denver school district has 10 days to decide. But the national conversation on this issue is far from over.
